A Call for TSMC and the Central Taiwan Science Park Bureau to Immediately Engage with Plaintiffs and Civil Society Groups to Re-evaluate the Environmental Impact of the Taichung 2nm Fab

Issuing Parties:

Joint Signatories:

[Statement Body]

Driven by concerns over the massive consumption of water and electricity, as well as the waste generation of TSMC’s Taichung 2nm Fab, 16 Taichung citizens (including several members of the “Parental-Child Learning GroupAssociation of Parent Participating Education in Taiwan” who are parents themselves) filed a lawsuit to revoke the project’s Environmental Impact Assessment (EIA) approval. They argue that the impact on Taichung’s environmental carrying capacity was not adequately assessed or addressed during the EIA process. February 12, the Taipei High Administrative Court ruled against the plaintiffs. While we respect the court’s decision, we will discuss whether to file an appeal after receiving the formal written judgment.

We emphasize that this case is not an opposition to advanced manufacturing processes or TSMC’s investment and development. On the contrary, precisely because 2nm technology represents the critical future of Taiwan’s semiconductor industry, its immense demand for resources—water, power, carbon emissions, and waste—requires an environmental risk assessment and social communication mechanism capable of supporting such a scale. We call on TSMC and the Central Taiwan Science Park (CTSP) Bureau to promptly discuss a re-evaluation of the 2nm Fab’s environmental impact with the plaintiffs and civil society groups.

The Taichung 2nm Fab is expected to consume an additional 8.1 billion kWh of electricity annually—equivalent to one-fourth of Taichung City’s total power consumption—increasing greenhouse gas emissions by 10%. Daily water consumption will reach 98,000 tons, representing 7% of the city’s tap water supply. Furthermore, daily waste generation is projected at 2,000 tons (pre-recycling), exceeding the total daily household waste of Taichung City. Such massive resource consumption and waste output clearly fall under the EIA Act’s criteria for “likelihood of significant environmental impact,” necessitating a more rigorous “Phase II Environmental Impact Assessment.”

In contrast to previous projects like CTSP Phase III, Phase IV, and the Qiaotou Science Park—all of which entered Phase II EIAs despite lower resource consumption—the 2nm Fab projects in Hsinchu, Taichung, and Kaohsiung have all bypassed this stage through expedited Phase I approvals. We believe this represents a significant regression in the EIA system.

The consequences of bypassing Phase II EIAs for 2nm projects across Taiwan are already surfacing. In the Hsinchu Baoshan 2nm project, the first to launch mass production, the Phase I EIA failed to carefully assess the timeline for reclaimed water supply. As construction lagged behind expectations, TSMC’s commitment to using 100% reclaimed water fell through, forcing an “Environmental Difference Analysis” (EDA) amendment. This has not only tightened Hsinchu’s water supply but also challenged the capacity of the science park’s sewage treatment and discharge, potentially limiting the capacity utilization of the Hsinchu 2nm Fab.

Similarly, during the EIA and litigation process for the Taichung 2nm project, we identified negligence regarding reclaimed water and wastewater treatment capacity. Crucial data on the actual demand and supply for waste recycling and final disposal were omitted, and the impact on Taichung City’s greenhouse gas reduction targets remains unassessed. These oversights present high risks to both the environment and operations. Therefore, we urge TSMC and the CTSP Bureau to immediately re-evaluate the environmental impacts and mitigation strategies for the Taichung project.

Furthermore, as TSMC rapidly expands in Global North countries such as the U.S., Japan, and Germany with resource-intensive advanced processes, its global stakeholder engagement has failed to keep pace.Last year, groups including the Kumamoto Environmental Thinking Group (Japan) and Chips Communities United (CCU, USA) attempted to contact relevant TSMC departments through third parties to request basic environmental information and dialogue. However, the Kumamoto Environmental Thinking Group received no response from TSMC or JASM (Japan Advanced Semiconductor Manufacturing), while CCU’s request was explicitly rejected.Meanwhile, TSMC’s planned expansion of advanced manufacturing and packaging capacity in Southern Taiwan continues to raise concerns regarding the ecological impact on the Yunlin, Chiayi, Tainan, Kaohsiung, and Pingtung regions.

We call on TSMC: as your processes become more advanced and your expansion more rapid, stakeholder communication must become more open and timely. The Taichung 2nm EIA lawsuit presents a prime opportunity to improve TSMC’s stakeholder engagement mechanism. We urge TSMC and the CTSP Bureau to initiate an Engagement process with the plaintiffs and civil groups to re-evaluate the environmental impacts of the Taichung 2nm Fab, thereby creating a new paradigm for environmental risk governance in the advanced semiconductor industry.

Appendix to the Statement:

【A Perspective from the Plaintiffs of the Association of Parent Participating Education in Taiwan (APPET): Preserving a Sustainable Living Space for Our Children】

As parents living in Taichung, our participation in this lawsuit is not out of malice, but rather out of a sense of responsibility toward the next generation. The massive daily water consumption of nearly 100,000 tons and the enormous volume of waste generated by the Central Taiwan Science Park (CTSP) 2nm Fab are issues that directly impact our children’s future environment.

We believe that true “competitiveness” should not be built solely on production capacity, but also on goodwill toward the land and respect for its residents. Our demand to reopen the dialogue regarding environmental impacts is not a stalling tactic; rather, it is a necessary “learning process” for the corporation and the public to engage in thorough discussion and clarify risks.

We want our children to see a society that thinks prudently for the sake of sustainability, rather than one that makes crude decisions by sacrificing proper procedures for the sake of speed.
